Terms of Service

1. Acceptance of these terms

By downloading, installing, or using PulseWave ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the App. These Terms form a legally binding agreement between you and HighRoad Software, a company registered in Belgium ("we," "us," or "our").

2. What PulseWave is — and isn't

PulseWave is a personal wellness application providing guided breathing exercises, meditation sessions, sleep tools, sound therapy, and an on-device AI coaching feature. It is designed for general stress management, relaxation, and wellness habit-building.

Some features involve breathing exercises, paced respiration, or physical relaxation techniques. If you have a cardiovascular condition, respiratory condition, epilepsy, are pregnant, or have any other health concern, consult a physician before using these features. Stop using any feature immediately if you feel unwell.

3. Eligibility

You must be at least 13 years old to use PulseWave. By using the App, you confirm that you meet this requirement. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. Account and authentication

PulseWave can be used without creating an account (anonymous mode). If you choose to sign in with Apple or Google, you also agree to comply with those providers' respective terms of service.

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. Notify us immediately at support@highroadsoftware.com if you suspect unauthorized access.

5. Subscriptions and in-app purchases

5a. Premium subscription

PulseWave offers an optional Premium subscription (monthly or yearly) that unlocks additional content and features. Subscriptions are purchased and billed through your Apple App Store account.

5b. Billing and renewal

• Your subscription automatically renews at the end of each billing period unless you cancel at least 24 hours before the renewal date.
• The renewal charge is applied to your App Store account within 24 hours before the end of the current period.
• The price shown at the time of purchase is the full amount billed per period.

5c. Free trials

When a free trial is offered, the trial period and its terms are clearly displayed before you confirm the purchase. Your subscription begins automatically when the trial ends and your payment method is charged unless you cancel before the trial period concludes.

5d. Cancellation

Cancel your subscription at any time through your Apple ID account settings:

Settings → Your Name → Subscriptions → PulseWave → Cancel Subscription

Cancellation takes effect at the end of the current billing period. You keep access to Premium features until that date. We do not refund unused portions of a subscription period except where required by applicable law.

5e. Restoring purchases

If you reinstall the App or switch devices, tap "Restore Purchases" on the Premium screen to recover your active subscription. You must be signed in with the same Apple ID used for the original purchase.

5f. Price changes

We reserve the right to change subscription prices. We will notify you of any price change through the App or by email before it takes effect. The new price applies from your next renewal. Continued use of the subscription after a price change takes effect constitutes acceptance of the new price. You can always cancel before that date.

6. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract the source code of the App.
• Use the App for any unlawful purpose or in violation of any applicable regulation.
• Attempt to gain unauthorized access to the App's backend systems or another user's data.
• Reproduce, duplicate, copy, sell, or commercially exploit any portion of the App without our express written permission.
• Interfere with or disrupt the integrity or performance of the App or its related systems.
• Use the App in a way that could cause harm to yourself or others.

7. Intellectual property

All content within PulseWave — including the guided audio sessions, breathing protocol designs, interface visuals, software, and underlying code — is the exclusive property of HighRoad Software or its licensors and is protected by copyright, trademark, and other intellectual property laws.

These Terms grant you only a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. No ownership rights are transferred to you.

8. User-generated content

Content you create in the App — journal entries, session notes, and custom sound presets — remains yours. You grant HighRoad Software a limited license to store and process that content on your device and, if you have an account, in your private cloud document, solely to provide the App's features to you. We do not use your journal entries or personal notes for any other purpose, including advertising, training AI models, or sharing with third parties.

9. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free, uninterrupted, or free of harmful components.

The on-device AI coaching feature identifies patterns in your mood and session data and offers suggestions. It is not a substitute for professional psychological or medical advice. If you are experiencing a mental health crisis, please contact a qualified professional or emergency services.

10. Limitation of liability

To the maximum extent permitted by applicable law, HighRoad Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses resulting from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

11. Termination

We reserve the right to suspend or terminate your access to the App if you breach these Terms, or if we discontinue the service. You may stop using the App and delete your account at any time via Settings → Account → Delete Account.

12. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes through the App or by email. Your continued use of PulseWave after changes take effect constitutes acceptance of the revised Terms. If you disagree, you may stop using the App and delete your account before the changes take effect.

13. Governing law

These Terms are governed by the laws of Belgium, without regard to conflict of law principles. Any dispute arising from these Terms shall be subject to the jurisdiction of the competent courts in Belgium. If you are a consumer resident in the EU, you also retain the benefit of any mandatory protective provisions of the law of your country of residence.
