Terms of Service

1. Acceptance of these terms

By downloading, installing, or using PulseWave ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the App. These Terms form a legally binding agreement between you and COBI Management SRL, a Belgian société à responsabilité limitée (limited liability company) trading as HighRoad Software, with its registered office at Rue Haut Chemin 8, 1370 Jodoigne, Belgium, registered with the Belgian Crossroads Bank for Enterprises (BCE) and VAT under number BE 0676.613.701 ("we," "us," "our," or "HighRoad Software"). These Terms are in addition to any agreement you have separately accepted with the Apple App Store or Google Play (see section 13).

2. What PulseWave is — and isn't

PulseWave is a personal wellness application providing guided breathing exercises, meditation sessions, sleep tools, real-time sound synthesis and an on-device AI coaching feature. It is designed for general stress management, relaxation and wellness habit-building.

2a. Specific cautions by feature

• Breathing protocols and breath retention. Some protocols involve paced respiration and breath holds. If you are pregnant, have a respiratory or cardiac condition, epilepsy, a history of panic attacks or dissociation, are recovering from illness or injury, or take medication affecting heart rate or blood pressure, consult a qualified clinician before using these features.
• Sound studio, binaural beats and isochronic pulses. The clinical evidence for brainwave entrainment is mixed and reported effects are subjective. Do not use binaural or isochronic audio while driving, cycling or operating machinery. Consult a clinician first if you have epilepsy, photosensitive seizures, severe migraine, vestibular conditions, hearing loss, tinnitus or any condition affected by rhythmic auditory stimulation.
• AI coach. The on-device AI coach is described in section 9. It is not a therapist, counsellor, psychiatrist or medical professional, and it is not designed for crisis intervention.
• Stop and seek help. Stop any feature immediately and seek medical attention if you experience dizziness, lightheadedness, chest pain, hyperventilation, tingling, vision changes, ear discomfort, persistent headaches, or any other adverse symptom.

2b. No therapeutic outcome warranty

We make no representation or warranty — express or implied — that the App will reduce your stress, improve your sleep, lower your heart rate, raise your heart rate variability, treat or alleviate any condition, produce any clinical effect, or yield any specific therapeutic outcome. Reported experiences are subjective and individual. The educational descriptions on this site and in the App reflect publicly available research; they are not personalised advice and do not guarantee results for you.

2c. Assumption of risk

You acknowledge that breathwork, meditation and audio practices — like any wellness practice — involve inherent risks that depend on your individual physiology, health status and how you use them. By using the App, you knowingly and voluntarily assume those risks. You agree that you are solely responsible for evaluating whether any feature is appropriate for you and for stopping at the first sign of adverse symptoms.

3. Eligibility

You must be at least 13 years old to use PulseWave. By using the App, you confirm that you meet this requirement. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. Account and authentication

PulseWave can be used without creating a named account. The current repository creates an anonymous Firebase Auth session for per-user app records. If you choose to link Sign in with Apple or Google for continuity, you also agree to comply with that provider's terms.

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. Notify us immediately at support@highroadsoftware.com if you suspect unauthorized access.

5. Subscriptions and in-app purchases

5a. Premium subscription

The repository supports an optional Premium subscription, but no public PulseWave subscription is live before the Store listing launches. If Premium is offered in the version you install, the available period, price, trial (if any), renewal terms and included features are the ones shown on the platform purchase sheet immediately before you confirm. Purchases are billed by the Apple App Store on iOS or Google Play on Android, as applicable.

5b. Billing and renewal

• Your subscription automatically renews at the end of each billing period unless you cancel at least 24 hours before the renewal date.
• The renewal charge is applied to your store account within 24 hours before the end of the current period.
• The price shown at the time of purchase is the full amount billed per period.

5c. Free trials

When a free trial is offered, the trial period and its terms are clearly displayed before you confirm the purchase. Your subscription begins automatically when the trial ends and your payment method is charged unless you cancel before the trial period concludes.

5d. Cancellation

Cancel your subscription at any time through your store account:

• iOS / Apple App Store: Settings → Your Name → Subscriptions → PulseWave → Cancel Subscription.
• Android / Google Play: Open the Google Play Store app → tap your profile icon → Payments & subscriptions → Subscriptions → PulseWave → Cancel subscription.

Cancellation takes effect at the end of the current billing period. You keep access to Premium features until that date. We do not refund unused portions of a subscription period except where required by applicable law.

5e. Restoring purchases

If you reinstall the App or switch devices, tap "Restore Purchases" on the Premium screen to recover your active subscription. You must be signed in with the same Apple ID (iOS) or Google account (Android) used for the original purchase. Subscriptions are tied to the platform store you purchased them on and cannot be transferred between iOS and Android.

5f. Price changes

We reserve the right to change subscription prices. We will notify you of any price change through the App or by email before it takes effect. The new price applies from your next renewal. Continued use of the subscription after a price change takes effect constitutes acceptance of the new price. You can always cancel before that date.

5g. Google Play specifics

For subscriptions purchased on Google Play, your purchase is also governed by the Google Play Terms of Service. Where the Google Play Terms differ from these Terms in respect of subscription mechanics (such as refund eligibility or grace periods), Google Play's then-current terms will prevail for that aspect of your subscription.

5h. EU / EEA right of withdrawal — express consent to immediate performance

EU/EEA consumers may have statutory withdrawal, conformity and refund rights under applicable law. Store purchases are also administered under the platform's purchase and refund process. Nothing in these Terms asks you to waive a non-waivable consumer right; the purchase sheet and the relevant store terms control any consent required before immediate supply of digital content or services.

6. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract the source code of the App.
• Use the App for any unlawful purpose or in violation of any applicable regulation.
• Attempt to gain unauthorized access to the App's backend systems or another user's data.
• Reproduce, duplicate, copy, sell, or commercially exploit any portion of the App without our express written permission.
• Interfere with or disrupt the integrity or performance of the App or its related systems.
• Use the App in a way that could cause harm to yourself or others.
• Rely on the App as a substitute for professional medical, psychological, psychiatric or emergency care.

7. Intellectual property

All content within PulseWave — including the guided audio sessions, breathing protocol designs, interface visuals, software, and underlying code — is the exclusive property of HighRoad Software or its licensors and is protected by copyright, trademark, and other intellectual property laws.

These Terms grant you only a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. No ownership rights are transferred to you.

8. User-generated content

Content you create in the App — journal entries, session notes and custom sound presets — remains yours. You grant HighRoad Software a limited license to store and process that content in local app storage and in the authenticated per-user Firebase record used by the current repository, solely to provide the App's features. Linking Apple or Google sign-in can preserve the record across devices. We do not use journal entries or personal notes for advertising, training shared AI models or unrelated third-party disclosure.

9. Disclaimers, the AI coach, and crisis resources

9a. General "as-is" disclaimer

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free, uninterrupted, or free of harmful components.

9b. No medical or therapeutic warranty

Without limiting section 2b, we do not warrant any specific health, mental-health, physiological or emotional outcome from your use of the App. Any educational references to research literature are descriptive, not promises. Individual results vary.

9c. The on-device AI coach

The AI coaching feature analyses your mood check-ins, journal entries and session history locally on your device, and offers educational reflections, pattern observations and cognitive-behavioural-style reframing suggestions. The coach is not a licensed therapist, counsellor, psychiatrist, psychologist or medical professional, and its suggestions are not professional clinical advice. The coach is not designed for, and must not be used for, crisis intervention, self-diagnosis, or making clinical treatment decisions. Suggested reframes are options to consider, not pronouncements.

9d. Crisis resources

If you are in crisis or experiencing thoughts of self-harm or suicide, do not rely on the App. Contact a qualified professional resource directly:

• United States — 988 Suicide & Crisis Lifeline (call or text 988).
• United Kingdom & Ireland — Samaritans, 116 123 (free, 24/7).
• European Union — 112 for emergency services.
• Belgium — Centre de Prévention du Suicide, 0800 32 123.
• International directory — findahelpline.com.

9e. Sound studio and rhythmic audio

The reported subjective effects of binaural beats, isochronic pulses and brainwave entrainment vary widely and the published clinical evidence is mixed. We make no claim that these features will produce any specific brain-state, cognitive, sleep, focus or relaxation outcome. Do not listen while driving, cycling or operating machinery. Stop listening and seek medical advice if you experience seizures, severe headaches, vertigo, nausea, ear pain or any other adverse symptom.

10. Limitation of liability

To the maximum extent permitted by applicable law, HighRoad Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses resulting from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our aggregate liability for any direct damages arising out of or in connection with the App or these Terms shall not exceed the greater of (i) the total amount you paid to us for Premium in the twelve months preceding the event giving rise to the claim, or (ii) fifty euros (€50). This limitation does not apply to liability that cannot be excluded or limited under your applicable mandatory consumer-protection law.

11. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend and hold harmless HighRoad Software, its officers, employees and contractors from and against any claim, demand, loss, liability or expense (including reasonable legal fees) arising from (a) your breach of these Terms or of any applicable law, (b) your misuse of the App or of any feature in a manner contrary to the cautions in section 2, or (c) your infringement of any third-party right through your use of the App. This clause survives termination of your account.

12. Trademarks

PulseWave and HighRoad Software are trademarks of HighRoad Software. All other trademarks, service marks, product names and logos appearing in the App or on this website — including Apple®, App Store, Google Play, iOS, Android, Firebase, llama.rn, and any competitor product names referenced in comparison content — are the property of their respective owners. References to third-party marks are for identification only and do not imply affiliation, sponsorship or endorsement.

13. Relationship with platform stores

13a. Apple App Store (iOS users)

You acknowledge and agree that:

• These Terms are concluded between you and HighRoad Software, not with Apple Inc. ("Apple"). HighRoad Software, not Apple, is solely responsible for the App and its content.
• Apple has no obligation to provide any maintenance or support services for the App.
• To the maximum extent permitted by applicable law, Apple has no warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be HighRoad Software's sole responsibility.
• HighRoad Software, not Apple, is responsible for addressing any claim by you or a third party relating to the App or your possession or use of it, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer-protection or similar legislation.
• In the event of a third-party claim that the App or your use of it infringes that party's intellectual property rights, HighRoad Software, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of that claim.
• You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist-supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with all applicable third-party terms of agreement when using the App (for example, your wireless data services agreement).
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

13b. Google Play (Android users)

When PulseWave is downloaded from Google Play, your use of the App is also governed by the Google Play Terms of Service. HighRoad Software, not Google, is responsible for the App, for support, and for any product-liability or consumer-protection claims.

14. Termination

We reserve the right to suspend or terminate your access to the App if you breach these Terms, or if we discontinue the service. You may stop using the App and delete your account at any time via Settings → Account → Delete Account.

15. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes through the App or by email. Your continued use of PulseWave after changes take effect constitutes acceptance of the revised Terms. If you disagree, you may stop using the App and delete your account before the changes take effect.

16. Governing law and jurisdiction

These Terms are governed by the laws of Belgium, without regard to conflict-of-law principles.

Subject to any non-waivable consumer-protection provisions of the law of your country of residence (which, if you are a consumer resident in the EU/EEA, you continue to benefit from), the French-speaking courts of the judicial district of Nivelles, Belgium (les tribunaux francophones de l'arrondissement judiciaire de Nivelles, Belgique) shall have exclusive jurisdiction over any dispute, controversy or claim arising out of or in connection with these Terms, their subject matter or their formation (including non-contractual disputes or claims).
