Terms of Use

Short version: HyperCam helps time iPhone captures but cannot guarantee a shot. Stay sheltered around storms, obtain consent before recording or photographing people, protect the device, and verify important results. Purchases use Apple. Mandatory consumer rights still apply.

1. Agreement and developer

These Terms are between the user and COBI Management SRL, trading as HighRoad Software, BE 0676.613.701, Rue Haut Chemin 8, 1370 Jodoigne, Belgium. They govern HyperCam Trigger, its widget and its Locked Camera Capture extension. The HighRoad portfolio terms also apply; these product terms control for HyperCam-specific matters.

2. Licence

Subject to these Terms and the acquisition terms, HighRoad grants a personal, limited, non-exclusive, non-transferable, revocable licence to use HyperCam on Apple-branded devices the user owns or controls, subject to Apple's Usage Rules and eligible Family Sharing or volume purchasing. The app may not be resold, sublicensed, rented, used to defeat purchase or security controls, or reverse engineered except where applicable law expressly permits it.

3. What HyperCam is — and is not

HyperCam is a photography utility for manual and sensor-assisted iPhone capture. Trigger modes analyse light, movement, sound, device motion, subjects or scene stability and then request a capture. It is not a meteorological warning system, scientific instrument, security camera, surveillance service, emergency service or guaranteed event recorder.

A trigger can fire late, early, repeatedly or not at all. Camera readiness, available light, frame rate, selected sensitivity, movement, microphone conditions, device capabilities, storage, battery, temperature and iOS behaviour can change the result. Always review the capture rather than assuming an event was recorded.

4. Safety and lawful use

  • Storms: never enter or remain in an unsafe area to photograph lightning. Use HyperCam only from a properly sheltered position and follow official weather and emergency guidance.
  • Attention: do not operate or monitor the app while driving, cycling, handling machinery or where distraction could cause harm.
  • People and property: respect privacy, image, publicity, copyright, trespass and location rules. Obtain any consent required for photography, audio, Speech processing or recording.
  • Tripods and unattended devices: secure the iPhone against falls, weather, theft, heat and obstruction. Do not leave it where it creates a hazard.
  • High-speed scenes: do not create explosions, impacts, projectiles or other dangerous events merely to trigger a photograph.

5. User content and optional providers

The user keeps rights they already hold in photographs, videos, audio-dependent results, documents, presets and exported files. The user is responsible for having the right to capture, process, upload and share them.

If the user configures Cloud Upscale, the selected provider's terms apply to uploaded images, API keys and results. Apple terms apply to Speech Recognition, Photos, sharing and platform services. HighRoad is not responsible for the availability, output, retention or security of a third-party endpoint the user chooses.

6. HyperCam Pro, subscriptions and purchases

The live App Store sheet controls the products, price, currency, taxes, trial, included features and renewal terms offered in the user's region. Development StoreKit prices, product plans and website previews are not offers before a public listing exists.

Auto-renewable subscriptions, if offered, are charged to the Apple ID at confirmation and renew unless cancelled under the terms shown by Apple. Users can manage or cancel subscriptions in Apple account settings. A lifetime unlock, if offered, is a non-consumable purchase for the version and features described at purchase; it does not promise every future product or paid service. HyperCam provides Restore Purchases for eligible Apple entitlements.

Apple handles billing and App Store refund requests. Nothing in these Terms removes statutory withdrawal, conformity, refund or other mandatory consumer rights.

6A. Founding 100 beta reward

Every eligible member of the HyperCam Founding 100 beta can receive HyperCam Premium Lifetime at no charge after both the final app and the non-consumable Lifetime In-App Purchase com.hrs.hypercam.pro.lifetime are approved and Ready for Distribution. This is a participation reward, not a lottery, contest or payment for praise. Honest negative feedback qualifies in the same way as positive feedback.

To qualify, a tester must complete all three steps by 10 September 2026 at 23:59 Europe/Luxembourg: (1) join one of the official cohorts below and install HyperCam Trigger build 1.0 (6); (2) complete at least one real capture mission using Lightning, Motion or Sound; and (3) submit useful TestFlight feedback describing what broke, what was confusing or what was expected but missing, with a voluntary contact email so HighRoad can deliver the reward.

The aggregate limit is 100 testers. Membership in more than one cohort does not create another reward. No purchase, App Store rating, positive review, public post or social-media share is required. One reward per person; it has no cash value and may not be resold.

Because public-link testers are anonymous to the developer, the contact email is used only to match participation evidence and deliver the Apple redemption code unless separate marketing consent is given. Delivery is targeted within 30 days after the app and Lifetime In-App Purchase are approved and Ready for Distribution. If Apple changes or withdraws the code mechanism before delivery, HighRoad will provide an equivalent lifetime entitlement through an App Store-compliant method.

7. Updates and compatibility

Camera features depend on the iPhone, lens, iOS version and Apple frameworks. RAW, ProRAW, maximum resolution, Locked Camera Capture, hardware capture controls, advanced boosts and some launch routes may not be available on every device. Updates can change or remove a workflow when required for safety, law, platform compatibility or product quality. Acquired rights and mandatory remedies remain protected.

8. Acceptable use

Do not use HyperCam unlawfully; invade privacy; harass, stalk or surveil others; infringe intellectual property; defeat permissions or platform safeguards; introduce malicious code; misuse Cloud Upscale credentials; or attempt unauthorised access to a device or service. Local processing does not make an unlawful capture or recording lawful.

9. Warranty and liability

HyperCam is provided “as is” and “as available” to the extent permitted by law. HighRoad does not promise that a trigger will detect or capture an event, that a photo will have a particular quality or evidentiary value, that a third-party service will remain available, or that the app will work uninterrupted on every device.

To the extent liability may lawfully be limited, HighRoad is not liable for indirect, incidental, special, consequential or punitive loss, and aggregate liability will not exceed the amount paid for HyperCam in the 12 months before the claim. These limits do not apply where prohibited, including fraud, wilful misconduct, death or personal injury caused by negligence, or mandatory consumer claims.

10. Apple terms

For an App Store copy: (a) these Terms are between the user and HighRoad, not Apple; (b) Apple has no obligation to provide maintenance or support; (c) if the app fails to conform to an applicable warranty, the user may notify Apple and Apple may refund the purchase price, while other remedies remain HighRoad's responsibility; (d) HighRoad, not Apple, is responsible for product and intellectual-property claims to the extent required by law; (e) the user must comply with applicable third-party terms; (f) the user represents that they are not in a US-embargoed country or on a US prohibited-party list; and (g) Apple and its subsidiaries are third-party beneficiaries and may enforce these Terms.

Where these Terms do not replace it, Apple's Standard Licensed Application End User License Agreement applies.

11. Termination, law and contact

The user may stop using HyperCam at any time. HighRoad may suspend a connected service or terminate a licence for material breach, fraud, unlawful use or a security threat, with notice and an opportunity to cure where appropriate and legally required.

Belgian law applies without depriving consumers of mandatory protection in their country of residence. Courts in Nivelles, Belgium have jurisdiction unless applicable consumer law permits proceedings elsewhere.
