Terms of Use — Games

1. Acceptance of Terms

By downloading, installing, or playing any mobile game published by HighRoad Software (each a "Game"), you agree to be bound by these Terms of Use. If you do not agree, do not use our Games.

HighRoad Software is a brand of COBI Management SRL, a Belgian private limited liability company (BE 0676.613.701), Rue Haut Chemin 8, 1370 Jodoigne, Belgium ("we", "us", or "our").

These Terms apply to all games listed on our Games page, including but not limited to: Lucky Slots, Poker Solitaire, Blackjack Club, SYNK, DRAW DUEL, SPLIT, Bluffline, Heist Relay, HEIST, MeetBlitz Lite, FACEOFF, TELL, WHISPER WARS, Neon Rep, Pinball Physique, Tap God, Reflex Duel, Smash the Stack, Dodge Millionaire, Shake to Smash, Balance Master, Tilt Platformer, Escape the Algorithm, AI or Human?, Brainrot Quiz, Rizz or Miss, Vibe Check Daily, Sentiment Wars, QR Adventures, QR Claim, Waifu Collector, Street Legends, Viral Architect, Infosphere, Marble Maze, and Bubble Pop.

2. Licence Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the Game on Apple devices that you own or control, for your personal, non-commercial entertainment purposes, in accordance with the Apple App Store Terms of Service.

This licence does not include the right to: sublicense, sell, resell, transfer, or commercially exploit the Game; modify, adapt, translate, or create derivative works; decompile, disassemble, or reverse-engineer the Game; remove or alter any proprietary notices; or use the Game in any way that violates applicable law.

3. Virtual Currency and Items

Some Games feature virtual currency (e.g., chips, coins, gems) and virtual items (e.g., characters, upgrades, cosmetics). You acknowledge and agree that:

  • Virtual currency and virtual items have no real-world monetary value and are not redeemable for real money, goods, or services.
  • Virtual currency and items are non-transferable and may not be sold, traded, or exchanged outside the Game.
  • We reserve the right to manage, regulate, modify, or remove virtual currency and items at any time, with or without notice.
  • You have no property right or ownership interest in any virtual currency or items.
  • Except as required by applicable law, all purchases of virtual currency and items are final and non-refundable.

4. In-App Purchases and Subscriptions

Some features of our Games are available through in-app purchases or auto-renewable subscriptions ("Premium Features"). All transactions are processed by Apple Inc. through the App Store. COBI Management SRL does not directly process payment information.

By making a purchase, you agree to Apple's App Store Terms of Service. Key points:

  • Prices are displayed in the App Store in your local currency and may vary by region.
  • Auto-renewable subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
  • Manage and cancel subscriptions at any time in your Apple ID settings (Settings > [Your Name] > Subscriptions).
  • No refunds are provided for partial subscription periods, except as required by applicable law or Apple's refund policies.
  • We reserve the right to change pricing with reasonable notice.

5. Gambling Disclaimer

Our casino-themed games (Lucky Slots, Poker Solitaire, Blackjack Club) are entertainment products only. No real gambling takes place.

  • No real money is wagered, won, or lost during gameplay.
  • Virtual chips and currency have no cash value and cannot be exchanged for real money or prizes.
  • Success in these games does not indicate success at real-money gambling.
  • These games are not gambling services and are not regulated as gambling under any jurisdiction.
  • These games are intended for an adult audience (ages 17+). They are not directed at minors.

6. Advertising

Some Games display third-party advertisements served by Google AdMob. You may purchase an ad-removal option (where available) to disable advertising within a specific Game. Ads are served in accordance with your device's privacy settings and the App Tracking Transparency framework.

7. App Store Rules

Our Games are distributed via the Apple App Store. Apple is not a party to these Terms and is not responsible for the Games or their content. You acknowledge that Apple has no obligation to furnish maintenance or support services for our Games. In the event of any failure of a Game to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Games.

For subscription-based features, Apple's standard End User Licence Agreement (EULA) applies in addition to these Terms: Apple Standard EULA.

8. User Conduct

You agree not to:

  • Use the Games in any way that violates applicable law or regulation
  • Exploit bugs, glitches, or unintended features for unfair advantage
  • Use cheats, automation software, bots, hacks, or any unauthorised third-party tools
  • Attempt to gain unauthorised access to our servers, other players' accounts, or any systems connected to the Games
  • Reverse-engineer, decompile, or disassemble any part of the Games
  • Harass, abuse, or harm other players in multiplayer games
  • Impersonate any person or entity

We reserve the right to restrict or terminate your access to any Game if you violate these Terms.

9. Intellectual Property

The Games and all associated content (including software code, designs, graphics, animations, sounds, characters, names, and trademarks) are the exclusive property of COBI Management SRL or its licensors. All rights not expressly granted are reserved.

10. Disclaimer of Warranties

Our Games are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Games will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by applicable law, COBI Management SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use or inability to use the Games.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Belgium, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Nivelles, Belgium.

If you are a consumer resident in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws in your country of residence.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via a notice on our Games page. The "last updated" date at the top always reflects the most recent version. Continued use of our Games after an update constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
