These Terms of Service ("Terms") are an agreement between you and HighRoad Software ("we", "us", "our") for your use of the Nomii iOS and watchOS application ("Nomii" or "App"). By downloading or using Nomii, you agree to these Terms.
These Terms are between you and HighRoad Software — not Apple. Apple is not responsible for the App or its content.
You must be able to enter a binding agreement under the laws of your country or region. If you are under the age of majority in your jurisdiction, you may only use Nomii with consent from a parent or legal guardian, who also agrees to these Terms on your behalf.
Nomii is a wellness-motivated virtual pet companion. It reads health data to make your pet feel alive, and it offers an AI-assisted chat experience for enjoyment and reflection.
Nomii is not a medical device. It does not provide medical advice, diagnosis, or treatment. Never rely on Nomii to make health or medical decisions. Always consult a qualified healthcare professional for anything health-related.
We grant you a personal, non-exclusive, non-transferable, revocable license to use Nomii on Apple devices you own or control, solely for personal, non-commercial purposes.

Nomii offers optional paid features through two subscription tiers (Plus and Premium) and consumable purchases (revival crystals). All payments are processed by Apple through your App Store account.

Prices are shown in your local currency at the time of purchase. We may update pricing with reasonable notice. Refunds are handled by Apple under Apple's refund policies — contact Apple Support for refund requests.
We reserve the right to change, add, or remove features at any time. If we remove a feature that is part of an active paid subscription tier, we will notify you and you may be entitled to a refund under Apple's policies.
If you reinstall the App or switch devices, use the "Restore Purchases" option in the App's Settings or paywall screens. Restoration requires being signed into the same Apple ID used for the original purchase.
Nomii may request read-only access to Apple Health data to power your pet's stats. Granting this access is optional. Nomii never writes data back to Apple Health. Health data is processed on-device and never transmitted to any external server. See our Privacy Policy for full details.
Nomii includes an AI-assisted chat feature. Responses are generated either by Apple's on-device AI model or by pre-written response templates — neither route sends your data to an external AI service. AI-generated responses are for entertainment and wellness engagement only. They may occasionally be inaccurate, incomplete, or unexpected. You remain solely responsible for any decisions or actions you take based on content in the App.
You own the content you create in Nomii (journal entries, pet names, custom sprites from photos). You grant us no rights to this content — it stays on your device. You agree not to input content that is unlawful, abusive, or infringes third-party rights.
All software, visual assets, animations, sounds, and branding in Nomii are owned by HighRoad Software or its licensors and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Nomii's assets without written permission.
To the maximum extent permitted by law, Nomii is provided "as is" and "as available." We make no warranties — express or implied — regarding availability, accuracy, fitness for a particular purpose, or uninterrupted operation. We are not liable for data loss caused by device failure, OS updates, or iCloud issues outside our control.
To the maximum extent permitted by applicable law, HighRoad Software will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising from your use of or inability to use Nomii. Nothing in these Terms limits liability that cannot be excluded under applicable mandatory consumer law in your jurisdiction.
You may stop using Nomii at any time by uninstalling it. We may suspend or terminate access if you materially violate these Terms. Termination does not entitle you to a refund for any remaining subscription period — refund requests are handled by Apple.
We may update these Terms from time to time. Material changes will be reflected by updating the effective date. Continuing to use Nomii after changes are posted constitutes acceptance of the revised Terms.
These Terms are governed by the laws applicable in your principal place of residence, except where otherwise required by mandatory consumer protection law. Nothing in these Terms limits rights you hold under applicable local consumer law.
Apple requires us to include the following acknowledgements. By using Nomii, you acknowledge that:
These Terms are a contract between you and HighRoad Software — not between you and Apple. Apple is not responsible for Nomii or its content.
Apple has no obligation to provide maintenance or support for Nomii.
In the event of a warranty claim, Apple's only obligation is, at its option, to refund the purchase price of the App. Apple has no other warranty obligation with respect to Nomii.
Apple is not responsible for product liability claims, legal compliance matters, or any consumer protection claims relating to Nomii.
If a third party claims Nomii infringes their intellectual property rights, HighRoad Software — not Apple — is responsible for addressing that claim.
You must comply with applicable third-party terms when using Nomii (for example, your mobile carrier's terms of service).
Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you as a third-party beneficiary.
