You buy FamilyLegacy once and use it on your Mac. Your data is yours.
You may not reverse-engineer the app or redistribute it.
We provide the software as-is and cannot be held responsible for data loss —
back up your .familytree file regularly.
1. Acceptance of terms
By downloading, installing, or using FamilyLegacy ("the Application"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Application.
The current release candidate is a paid-upfront Mac App Store app. If HighRoad later offers a separate direct build, the live checkout and any channel-specific licence terms shown before purchase also apply.
2. License grant
Subject to your compliance with these Terms, HighRoad Software grants you a personal, non-exclusive, non-transferable, revocable license to install and use FamilyLegacy on Mac computers that you own or control.
Mac App Store copy
A copy obtained through the Mac App Store is governed by Apple's Standard End User License Agreement in addition to these Terms. The App Store build is paid upfront and includes the features identified in its live listing; the purchase sheet controls the final local price and transaction terms.
Direct copy, if offered
No direct checkout is currently advertised. If a direct build is offered later, its checkout will state the permitted devices, licence duration, update entitlement, merchant, price, taxes, and refund route before purchase. A direct licence key may not be resold or shared except where applicable law requires otherwise.
3. Restrictions
You may not:
- Copy, modify, distribute, sell, or sublicense the Application or any part of it
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Application
- Remove, alter, or obscure any proprietary notices, labels, or marks on the Application
- Use the Application for any unlawful purpose or in violation of any applicable laws or regulations
- Use automated tools to scrape, extract, or systematically access Application functionality
- Circumvent or disable any licensing, copy-protection, or security mechanisms in the Application
4. Ownership of your data
All genealogy data you create, import, or store within FamilyLegacy remains your property.
HighRoad Software claims no ownership over your data. The .familytree file on your Mac
belongs to you entirely.
You are solely responsible for backing up your data. HighRoad Software strongly recommends
maintaining regular backups of your .familytree files using Time Machine or another
backup solution, as well as periodic GEDCOM exports as an additional safeguard.
5. Updates and changes to the Application
HighRoad Software may release updates to FamilyLegacy that add, modify, or remove features. Updates delivered through the Mac App Store are subject to Apple's update policies. For a direct build, if offered, the checkout and release notes will state the included update period. A later major version may require a separate purchase if that was disclosed before the original purchase.
HighRoad Software reserves the right to discontinue the Application or any feature at any time with reasonable notice. In the event of discontinuation, previously installed versions will continue to function on compatible macOS versions, and your data remains accessible.
6. Refunds and cancellations
App Store purchases
App Store payment and refund requests are processed by Apple under Apple's procedures. Mandatory consumer rights and any remedies that cannot lawfully be excluded remain unaffected.
Direct license purchases
No direct checkout is currently live. If one is offered, the checkout will identify the merchant and applicable cancellation/refund terms. Those terms will not limit mandatory consumer rights.
7. Disclaimer of warranties
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
HighRoad Software does not warrant that the Application will be error-free, uninterrupted, or free of security vulnerabilities. Use of the Application is at your own risk. You are responsible for maintaining backups of any data you enter into the Application.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HIGHROAD SOFTWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF BUSINESS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APPLICATION, EVEN IF HIGHROAD SOFTWARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL HIGHROAD SOFTWARE'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE APPLICATION IN THE TWELVE MONTHS PRECEDING THE CLAIM.
9. Intellectual property
FamilyLegacy, its design, code, visual assets, charts, report templates, and all related intellectual property are owned by HighRoad Software and protected by copyright, trademark, and other applicable laws. These Terms do not transfer any intellectual property rights to you.
The name "FamilyLegacy" and the HighRoad Software logo are trademarks of HighRoad Software. You may not use them without prior written consent.
10. Third-party services
FamilyLegacy may integrate with or allow connections to third-party services, including Apple/iCloud, FamilySearch, model-download hosts, and App Store infrastructure. Your use of such third-party services is subject to those services' own terms and privacy policies. HighRoad Software is not responsible for the practices or content of third-party services.
11. Governing law and disputes
These Terms are governed by the laws of Belgium, without regard to its conflict of law provisions. Courts and dispute-resolution bodies have jurisdiction as determined by applicable law.
If you are a consumer resident in the EU, you also retain the benefit of any mandatory protections provided by the consumer protection laws of your country of residence.
12. Changes to these Terms
HighRoad Software may update these Terms from time to time. Material changes will be communicated through the Application's release notes or a notice on our website. Your continued use of the Application after such changes constitutes acceptance of the updated Terms. The current version of these Terms is always available at this URL.
13. Apple-distributed copies
For a copy obtained through Apple, these Terms are between you and HighRoad Software, not Apple. Apple has no duty to provide maintenance or support. HighRoad is responsible for product and intellectual-property claims to the extent required by law. If the app fails to conform to an applicable warranty, you may notify Apple for a refund of the purchase price; other remedies remain HighRoad's responsibility. You must comply with third-party terms and represent that you are not in a sanctioned country or on a prohibited-party list. Apple and its subsidiaries are third-party beneficiaries and may enforce these Terms. The licence is limited to Apple-branded devices you own or control, subject to Apple's Usage Rules, including eligible Family Sharing.
